Cusano’s Baking Company (“Cusano’s,” “we,” “us,” or “our”) reserves the right to refuse or limit access to any user that does not meet these criteria.

• sample request functionality for qualified business customers; and
• communication tools for connecting with Cusano’s.

Cusano’s may modify, suspend, or discontinue any aspect of the Site at any time, without liability.

4. Sample Requests

Samples are:

• intended solely for internal business evaluation; and
• subject to availability, verification, and approval.

Cusano’s may limit quantities or decline any request in its sole discretion.

Samples may not be resold, redistributed, or used for any purpose other than internal evaluation.

5. Intellectual Property

13. Governing Law; Venue; Waiver of Class Actions

You agree that any dispute will be resolved on an individual basis only and not as part of any class, collective, consolidated, or representative action.

Cusano’s failure to enforce any provision is not a waiver of that provision.

Cusano’s shall not be liable for any delay or failure resulting from causes beyond its reasonable control.

16. International Use

The Site is intended for use by businesses located in the United States.

Cusano’s makes no representation that the Site is appropriate or available for use outside the United States.

Users who access the Site from outside the United States do so at their own risk and are responsible for compliance with local laws.
